OVERVIEW
Welcome to Nub's Media. The terms "we", "us", and "our" refer to Nub's Media.
Nub's Media operates this website and online store, including the information, database, community features, content, tools, products, and services made available through it (collectively, the "Services"). Our store is powered by Shopify, which provides the ecommerce platform used to offer the Services.
These Terms of Service ("Terms") describe the terms that apply when you access or use the Services, participate in Nub's Media community features, submit content, or purchase products from Nub's Media.
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.
Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded under applicable consumer-protection law.
SECTION 1 - ACCESS, ELIGIBILITY, AND ACCOUNTS
You must use the Services only for lawful purposes.
The Services are intended for adults. You must be at least 18 years old and legally capable of entering into the applicable agreement in your jurisdiction to create or use a customer/community account, make a purchase, submit content, or participate in interactive community features.
Public informational and database pages may be viewable without an account. If you do not meet the eligibility requirements above, do not create an account, make a purchase, or submit content through the Services.
If you create or use a customer account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
You agree that information you provide to us, including contact, billing, payment, and shipping information, will be accurate and current.
You must not use another person's account without authorization or use the Services in a manner that interferes with their normal operation or security.
SECTION 2 - PRODUCTS AND PRODUCT INFORMATION
Nub's Media makes reasonable efforts to provide accurate product titles, descriptions, images, prices, availability, edition information, region information, audio and subtitle details, condition information, and other product information.
Product appearance may vary slightly from photographs because of display settings, packaging revisions, manufacturer changes, slipcover availability, or other differences outside our control.
Unless a listing specifically states otherwise, trademarks, character names, logos, artwork, packaging artwork, screenshots, and other third-party intellectual property remain the property of their respective owners.
Products may be changed, corrected, discontinued, or removed from sale without notice.
We may limit quantities where reasonably necessary, including to address inventory errors, suspected fraud, unusual purchasing activity, or limited supply.
SECTION 3 - INVENTORY
When a product is identified as In stock, Nub's Media intends that the inventory be physically on hand in Ontario unless the product listing clearly states otherwise.
Inventory quantities can occasionally become incorrect because of technical errors, simultaneous purchases, damaged inventory, or other circumstances.
If an item becomes unavailable after an order is placed, we will contact you and provide an appropriate resolution, which may include cancelling and refunding the affected item or order.
SECTION 4 - ORDERS
Submitting an order is an offer to purchase the products shown in your order.
An order may be declined or cancelled where reasonably necessary, including because of inventory errors, incorrect pricing or product information, payment issues, suspected fraud, shipping restrictions, or other circumstances that prevent us from fulfilling the order.
If we cancel an order or item after payment has been collected, the applicable amount will be refunded.
Please review your order carefully before submitting it.
Order cancellation requests
Customers may request cancellation before an order has entered fulfillment.
We will make reasonable efforts to accommodate cancellation requests received before shipment, but cancellation is not guaranteed.
Contacting us as soon as possible increases the likelihood that we can cancel the order.
Once an order has been packed, processed for shipment, handed to a carrier, or has otherwise progressed too far in fulfillment to reasonably stop it, cancellation might no longer be possible.
Our Return and Refund Policy applies after shipment.
SECTION 5 - PRICES, CURRENCY, TAXES, AND PAYMENT
Prices shown by Nub's Media are displayed in Canadian dollars (CAD) unless otherwise clearly indicated.
Prices, discounts, promotions, and availability may change without notice.
The price charged will be the price shown for the product at the time the order is submitted, subject to correction of obvious pricing or technical errors.
Applicable taxes, shipping charges, and any other charges will be displayed during checkout before the order is submitted.
For destinations where customs duties, brokerage fees, import taxes, or similar charges may apply, those charges may be the responsibility of the recipient unless otherwise stated during checkout.
You agree to provide accurate payment and billing information and to use only payment methods that you are authorized to use.
SECTION 6 - SHIPPING AND DELIVERY
Nub's Media ships from Ontario, Canada.
Orders are normally dispatched according to the shipping schedule described in our Shipping Policy.
Available shipping destinations, shipping methods, rates, and delivery estimates are determined by the options made available during checkout.
We do not guarantee carrier delivery estimates. Weather, carrier delays, customs processing, service disruptions, holidays, or other events outside our reasonable control can affect delivery times.
If an order is significantly delayed, appears lost, or arrives damaged, please contact Nub's Media so we can investigate and work toward an appropriate resolution.
Nothing in this section limits cancellation, refund, delivery, or other rights that may apply under applicable law.

SECTION 7 - RETURNS, DEFECTIVE ITEMS, AND REFUNDS
Nub's Media does not currently accept returns or exchanges solely because a customer has changed their mind.
If an item arrives damaged, is defective, or differs from what was ordered, please contact us as soon as reasonably possible.
Depending on the circumstances, an appropriate resolution may include replacement of the item or affected component, a partial refund, a full refund, or return of the affected item.
Where Nub's Media requires the return of an item because it arrived damaged or defective or because we sent the wrong item, we will provide or reimburse reasonable return-shipping costs in accordance with the instructions we provide.
Bundle Deals! may be resolved at the individual-component level where appropriate rather than requiring return of the entire bundle.

Nothing in our Return and Refund Policy limits rights or remedies that cannot lawfully be excluded.
SECTION 8 - BUNDLE DEALS!
Bundle Deals! are predefined discounted combinations selected by Nub's Media.
Unless expressly stated otherwise, customers cannot substitute or customize the products included in a Bundle Deal.
Bundle availability depends on the availability of the products contained in the bundle.
Prices and savings shown for Bundle Deals! may change if the prices of the included products change.
SECTION 9 - DATABASE AND COMMUNITY FEATURES
Nub's Media may provide a physical-media database and community tools such as Collections, Wanted Lists, public profiles, discussion forums, release discussions, reviews, private messages, notifications, reports, contribution tools, and related features.
Database information is provided for reference and may be corrected, expanded, reorganized, or removed as new information becomes available.
Community features may be subject to additional technical limits, moderation rules, rate limits, visibility controls, or account requirements intended to protect users and the Services.
Nub's Media may restrict, suspend, remove, or discontinue community features or content where reasonably necessary for safety, security, moderation, legal compliance, abuse prevention, or reliable operation of the Services.
SECTION 10 - USER CONTENT AND COMMUNITY CONDUCT
If the Services allow you to submit reviews, forum posts, comments, database contributions, images, messages, suggestions, reports, or other content ("User Content"), you are responsible for what you submit.
You retain ownership of User Content to the extent that you own rights in it. These Terms do not transfer ownership of your original User Content to Nub's Media.
You must not submit User Content that is unlawful, knowingly false, defamatory, infringing, abusive, threatening, harassing, malicious, deceptive, impersonating, privacy-invasive, or that violates another person's rights.
Public-facing written contributions should be your own writing. Do not copy reviews, articles, posts, scripts, or other substantial copyrighted material from elsewhere without permission or another lawful basis. Do not divide copied material across multiple posts or submissions in order to evade content limits or moderation controls.
If you submit material created by another person, you are responsible for having the rights, permission, or other lawful basis needed to submit and use that material.
By submitting User Content intended for publication or display through Nub's Media, you grant Nub's Media a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, publish, distribute, moderate, and technically adapt that content as reasonably necessary to operate, secure, promote, and improve the Services. This permission does not transfer ownership of your User Content to Nub's Media.
Public contributions may remain available in anonymized form after an account is deleted where described in our Privacy Policy. Private content is handled according to the applicable feature and our Privacy Policy.
Nub's Media may review, approve, reject, hide, edit for technical formatting, or remove User Content where reasonably necessary to enforce these Terms, community rules, legal obligations, or safety/security requirements. Approval or publication by Nub's Media does not mean that Nub's Media has independently verified ownership, accuracy, legality, or every right associated with the content.
SECTION 11 - REPORTING CONTENT AND COPYRIGHT CONCERNS
Users may report community content using the reporting tools provided through the Services where available.
If you believe content on Nub's Media infringes your copyright or other rights, you may use the applicable report function or contact us at contact@nubsmedia.ca. Please identify the material at issue, where it appears, the right you believe is affected, and enough information for us to understand and review the concern.
Nub's Media may temporarily hide, remove, restrict, or preserve relevant information while reviewing a report or legal complaint, as reasonably appropriate and as permitted or required by law.
Abusive, knowingly false, or intentionally misleading reports may themselves violate these Terms.
SECTION 12 - THIRD-PARTY LINKS AND SERVICES
The Services may contain links to, embeds from, or functionality provided by third parties.
Nub's Media is not responsible for the content, availability, privacy practices, security, or accuracy of third-party websites or services that we do not control.
If you choose to use a third-party website or service, its own terms and policies may apply.
SECTION 13 - SHOPIFY
Nub's Media is powered by Shopify, which provides the ecommerce platform used to operate the Services.
Purchases made through this store are transactions between you and Nub's Media.
Shopify provides platform, payment, account, catalog, checkout, and related infrastructure but is not the seller of products offered by Nub's Media.
Certain information may be processed by Shopify in accordance with Shopify's applicable terms and privacy practices.
SECTION 14 - PRIVACY
Personal information collected through the Services is handled in accordance with the Nub's Media Privacy Policy:

Because the store is hosted by Shopify, Shopify and service providers used to operate the store may also process information as described in the applicable privacy disclosures.
Please review the Privacy Policy for additional information about how personal information is collected, used, disclosed, retained, and protected.
SECTION 15 - INTELLECTUAL PROPERTY
The original website design, branding, written material, graphics, photographs, software, and other content created or owned by Nub's Media are protected by applicable intellectual-property laws.
Product names, titles, characters, artwork, logos, trademarks, packaging artwork, video, promotional materials, and other third-party intellectual property remain the property of their respective owners.
Their appearance on Nub's Media is for purposes such as identifying, describing, displaying, or promoting genuine products and database entries and does not by itself imply sponsorship, affiliation, or endorsement.
You may not reproduce or exploit Nub's Media-owned website content for commercial purposes without permission except where permitted by law.
SECTION 16 - ERRORS AND CORRECTIONS
Occasionally information on the Services may contain typographical errors, inaccuracies, omissions, or technical problems relating to product descriptions, database information, inventory, pricing, promotions, shipping charges, delivery estimates, or availability.
We may correct errors or update information when discovered.
If a material error affects an order you have already placed, we will contact you where appropriate and provide a reasonable opportunity to resolve the issue, including cancellation and refund where required.
SECTION 17 - PROHIBITED USES
You may not use the Services:
- for unlawful, fraudulent, abusive, threatening, harassing, or malicious activity;
- to infringe the rights of Nub's Media or another person;
- to post or distribute content you do not have the right to submit;
- to reveal another person's private or personal information without authorization;
- to impersonate another person or entity;
- to evade content, moderation, posting, or rate limits, including by splitting prohibited or copied material across multiple submissions;
- to introduce viruses, malware, or harmful code;
- to interfere with the security or normal operation of the Services;
- to circumvent access controls, rate limits, CAPTCHAs, or other technical protections;
- to collect personal information about other users without authorization;
- to conduct unauthorized scraping, bulk extraction, or automated access contrary to our published technical instructions.
Automated access is permitted where it is expressly supported or authorized through interfaces or instructions made available by Nub's Media or Shopify, including applicable robots.txt, agents.md, Universal Commerce Protocol (UCP), MCP, Shopify-supported shopping-agent tools, or other expressly authorized systems.
Permitted automated systems must comply with the relevant published instructions, identify themselves where required by the applicable protocol, respect rate limits and access controls, and must not bypass security measures.
SECTION 18 - AI AGENTS AND SHOPPING ASSISTANTS
Nub's Media supports compatible automated shopping agents and personal assistants through Shopify-supported commerce infrastructure and other expressly authorized interfaces.
Agents acting on behalf of customers must follow the technical and authorization requirements published by the store and applicable platform.
An agent must not complete payment or place a final order on a customer's behalf without any human approval required by the applicable commerce or payment system.
Agents must not evade technical restrictions, conceal their identity where identification is required, circumvent CAPTCHAs or security measures, or use unauthorized access methods.
Nub's Media may restrict, suspend, or modify automated access where necessary for security, reliability, fraud prevention, abuse prevention, or compliance.
SECTION 19 - MARKETING COMMUNICATIONS
Where Nub's Media offers optional newsletters, promotional emails, or other marketing communications, those communications will be sent only where permitted by applicable law and according to the communication choices available through the Services.
You may unsubscribe from promotional email using the unsubscribe mechanism provided in the message or through other available preference controls. Opting out of promotional communications does not prevent us from sending non-promotional communications relating to orders, accounts, security, support requests, or other transactions you initiate.
SECTION 20 - SERVICE AVAILABILITY
We do not guarantee that the Services will always be uninterrupted, error-free, or available.
Access may occasionally be interrupted because of maintenance, technical problems, third-party services, security events, or circumstances outside our control.
We may modify or discontinue features of the Services where reasonably necessary.
SECTION 21 - DISCLAIMER OF WARRANTIES
To the extent permitted by applicable law, the Services are provided on an "as available" basis.
We do not guarantee that the Services will be uninterrupted or free of technical errors.
Nothing in these Terms excludes or limits statutory warranties, conditions, guarantees, consumer rights, or remedies that cannot lawfully be excluded or limited.
SECTION 22 - LIMITATION OF LIABILITY
To the extent permitted by applicable law, Nub's Media will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Services where such liability may lawfully be excluded.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or any rights and remedies provided by applicable consumer-protection law.
SECTION 23 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, or reasonable costs arising directly from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person's rights.
This section does not apply to the extent that a claim or loss resulted from the acts or omissions of Nub's Media or where such responsibility cannot lawfully be imposed.
SECTION 24 - TERMINATION AND RESTRICTION OF ACCESS
We may restrict or terminate access to accounts or Services where reasonably necessary because of fraud, abuse, unlawful activity, security concerns, material violation of these Terms, repeated infringement or rights violations, or threats to the Services or other users.
Termination does not affect obligations or rights that arose before termination.
SECTION 25 - SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be limited or severed to the extent necessary, and the remaining provisions will continue to apply.
SECTION 26 - WAIVER AND ENTIRE AGREEMENT
A failure by Nub's Media to enforce a provision of these Terms does not waive that provision or any other right.
These Terms, together with policies expressly incorporated into them, constitute the agreement governing use of the Services, subject to rights and obligations imposed by applicable law.
SECTION 27 - GOVERNING LAW
These Terms and any separate agreements relating to the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.
Subject to any mandatory consumer rights, jurisdiction, or dispute-resolution rights that apply under law, disputes relating to these Terms will be subject to the jurisdiction of the courts of Ontario.
SECTION 28 - CHANGES TO THESE TERMS
The current version of these Terms will be available on this page.
We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements, or other circumstances.
Where required by applicable law, we will provide notice of material changes.
Changes will take effect on the date indicated by the updated Terms or as otherwise required by law.
