Nub's Media operates this store and website, including the physical-media database, customer and community account features, Collection and Wanted List tools, forums, reviews, private messages, contribution tools, and related information, content, features, products, and services (collectively, the "Services"). Nub's Media is powered by Shopify, which enables us to provide the Services.

This Privacy Policy describes how we collect, use, disclose, retain, and otherwise process personal information when you visit or use the Services, make a purchase or other transaction, create or use an account, participate in community features, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of personal information.

Please read this Privacy Policy carefully. By using and accessing the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of information described in it.

Personal Information We Collect or Process

When we use the term "personal information," we mean information that identifies or can reasonably be linked to you or another person. Personal information does not include information that has been anonymized or de-identified so that it cannot reasonably be linked to an identifiable person.

Depending on how you interact with the Services, where you live, and what features you choose to use, we may collect or process the following categories of personal information:

  • Contact details, including your name, address, billing address, shipping address, phone number if provided, and email address.
  • Financial and payment information, including transaction details, form of payment, payment confirmation, and other payment-related information. Payment card details may be processed by Shopify and payment providers rather than directly stored by Nub's Media.
  • Store and transaction information, including products you view, place in your cart, purchase, return, exchange, or cancel, your order history, shipping information, and related transaction records.
  • Account information, including account identifiers, username, account status, preferences, settings, security-related information, and information associated with your Shopify customer account.
  • Collection and Wanted List information, including database releases you add to your Collection or Wanted List, import/export activity, public-list visibility choices, and related feature settings.
  • Community profile and preference information, including your community username, username history or reservation information where applicable, notification preferences, blocked-member settings, public-list settings, and other community account preferences.
  • Community contributions, including forum posts, release discussions, reviews, database change requests, new-entry submissions, captions, and other content you intentionally submit for publication or community use.
  • Private communications, including private messages sent through Nub's Media and communications you send to Nub's Media through contact, support, or other private forms.
  • Moderation and safety information, including reports you submit or receive, moderation outcomes, abuse-prevention information, rate-limit and security information, and records reasonably needed to protect users or the Services.
  • Device information, including information about your device, browser, network connection, IP address, and other technical identifiers.
  • Usage information, including information about how and when you interact with or navigate the Services, where collected through Shopify, server logs, cookies, browser storage, or similar technologies.
  • Marketing preferences, including whether you have chosen to receive optional promotional communications and information reasonably needed to honour your communication choices.

We do not intentionally ask users to provide sensitive personal information through public community fields. Please do not post private account information, addresses, private messages, confidential documents, or other sensitive personal information in public areas of the Services.

Personal Information Sources

We may collect personal information from the following sources:

  • Directly from you, including when you create or use an account, make a purchase, maintain a Collection or Wanted List, submit community content, communicate with us, submit a report, or otherwise provide information to the Services.
  • Automatically through the Services, including from your device when you use the Services and through cookies, browser storage, server logs, and similar technologies.
  • From Shopify and our service providers, including when they provide ecommerce, hosting, payment, authentication, analytics, security, storage, or other technology used to operate the Services.
  • From partners or other third parties, where appropriate and permitted by law, including shipping carriers, payment providers, fraud-prevention providers, or other services involved in transactions you request.

How We Use Your Personal Information

Depending on how you interact with us or which Services you use, we may use personal information for the following purposes:

  • Provide, operate, and improve the Services. We use information to process payments and orders, arrange shipping, manage returns or refunds, create and maintain accounts, operate the physical-media database, maintain Collection and Wanted List features, provide public-list and Collection-coverage features, deliver notifications, operate forums and reviews, provide private messaging, process database contributions, remember settings, and otherwise provide features you request.
  • Community publishing and identity. When you intentionally submit public community content, we use your community username and related information to attribute, display, organize, and moderate that content. Public-list information is shown only when you choose to make the applicable list public.
  • Moderation, safety, and abuse prevention. We use information to review reports and submissions, enforce community and account rules, prevent spam and abuse, authenticate users, detect suspicious or malicious activity, apply rate limits, protect public safety, and secure the Services.
  • Customer support and communications. We use information to respond to support requests, order questions, account issues, database inquiries, privacy requests, reports, and other communications you initiate.
  • Marketing and advertising where used and permitted. If Nub's Media offers optional promotional communications or uses marketing features, we may use information to send marketing or promotional communications where you have chosen to receive them or where another lawful basis applies. Shopify may also provide advertising or marketing-related features subject to Shopify's own privacy practices and the settings available to you. We do not require you to subscribe to promotional communications in order to use ordinary store or community features.
  • Legal and compliance purposes. We use information to comply with applicable law, respond to valid legal process, investigate or participate in disputes or legal proceedings, protect our rights and those of users or others, and enforce or investigate potential violations of our Terms or policies.
  • Nub's Media may use de-identified or aggregated Collection and Wanted List activity to produce popularity statistics and rankings. Popularity counts are stored as anonymous aggregate totals and do not identify which members have added a particular release.

Public and Private Community Information

Some Nub's Media features are intentionally public or may be made public by your choices.

Your community username and public contributions, such as forum posts, release discussions, approved reviews, and approved database contributions, may be visible to other visitors. If you choose to make your Collection or Wanted List public, the applicable list may be visible from your community profile until you turn that setting off.

Private messages are intended only for the participants and authorized moderation or administrative access where reasonably necessary for operation, safety, legal compliance, or abuse handling. Moderation reports and private support submissions are not intended for public display.

Please remember that information you intentionally publish to a public or semi-public area can be copied, quoted, indexed, or otherwise used by other people outside our control.

Account Deletion and Anonymization

Nub's Media provides a deletion process for the Nub's Media community/account layer. This process is separate from Shopify customer/order records and does not necessarily delete records that Shopify or Nub's Media must retain for completed transactions, taxes, fraud prevention, legal obligations, or other permitted purposes.

When a Nub's Media community account is deleted through our deletion process, private Nub's Media account information and feature data such as the Collection, Wanted List, account preferences, and other private community data are removed or scrubbed according to the feature. Content of private messages sent by the deleted account is scrubbed from the surviving conversation, while a placeholder may remain so the other participant's conversation history remains understandable.

Public contributions such as forum posts, reviews, and approved database contributions may remain available in anonymized form and be attributed to a deleted-user placeholder rather than to the deleted account. The prior username may be temporarily reserved for account-security and re-creation purposes. We may also retain limited information where reasonably necessary for legal obligations, security, fraud prevention, dispute resolution, or enforcement of our policies.

Collection and Wanted List export tools are available through the account area to help users retain copies of those lists before deletion or for their own records.

How We Disclose Personal Information

In certain circumstances, we may disclose personal information to third parties for legitimate purposes consistent with this Privacy Policy, including:

  • Shopify and service providers that perform services on our behalf or provide infrastructure used by the Services, such as ecommerce hosting, payment processing, customer authentication, cloud infrastructure, security, data storage, analytics, customer support, fulfillment, and shipping.
  • Shipping carriers, payment providers, and transaction partners where disclosure is reasonably necessary to complete or support a transaction you requested.
  • Business and marketing partners, if and when we use marketing or advertising services and where the disclosure is permitted by applicable law and consistent with your available choices. Shopify may support personalized advertising or related services based on information processed through Shopify; Shopify's own privacy disclosures explain those activities and available rights or controls.
  • Third parties you direct us to use or interact with, such as social-media services, integrations, or other services you choose to access.
  • Professional advisers, authorities, courts, or other recipients where reasonably necessary to comply with applicable law or legal process, enforce our Terms or policies, investigate fraud or abuse, protect the Services or public safety, resolve disputes, or defend legal rights.
  • Parties involved in a business transaction, such as a merger, acquisition, financing, restructuring, or sale of business assets, subject to applicable law.

We do not treat public community content that you intentionally publish as private information, but we continue to apply our Terms, moderation rules, and privacy practices to the account data associated with that content.

Relationship with Shopify

The Services are powered and hosted through Shopify and related Shopify infrastructure. Shopify collects and processes personal information about access to and use of the Services in order to provide and improve Shopify-powered services.

Information you submit to the Services may be transmitted to and processed by Shopify and service providers that may be located in countries other than where you reside. Shopify may also provide enhanced features that use information obtained from interactions with our store, other merchants, and Shopify. In circumstances where Shopify determines the purposes and means of its own processing, Shopify is responsible for that processing and for responding to applicable privacy requests concerning that processing.

Cookies, Browser Storage, and Similar Technologies

The Services and Shopify may use cookies, local storage, session storage, IndexedDB, server-side sessions, and similar technologies to provide authentication, security, preferences, shopping functions, database performance, account features, analytics, and other functionality.

Some storage is necessary for requested features or security. Other analytics, marketing, advertising, or personalization technologies may be controlled by Shopify privacy settings, consent tools, browser controls, or other preference mechanisms where applicable.

Additional details may be provided through Shopify's customer-privacy tools or a separate cookie/privacy notice as our implementation evolves.

Marketing Communications

If you choose to sign up for optional promotional emails or other marketing communications, we may use your contact information and marketing preferences to send those communications in accordance with applicable law.

You may opt out of promotional email at any time using the unsubscribe option included in the message or another available preference control. If you opt out of promotional communications, we may still send non-promotional communications relating to your account, orders, security, private-message or community notifications you have enabled, customer support, or other transactions and requests you initiate.

Third-Party Websites and Links

The Services may provide links to websites or online platforms operated by third parties. If you follow links to sites not affiliated with or controlled by Nub's Media, you should review their privacy and security practices and their terms and conditions.

We do not guarantee and are not responsible for the privacy, security, accuracy, completeness, or reliability of third-party sites or services we do not control. Our inclusion of a link does not by itself imply endorsement of that site's content, owners, or operators.

Children's Data

The Services are intended for adults. Account creation, purchases, content submission, and interactive community participation are intended for users who are at least 18 years old and legally capable of entering into the applicable agreement in their jurisdiction.

We do not knowingly collect personal information from children through the Services. If you are a parent or guardian and believe a child has provided personal information to Nub's Media, please contact us so that we can review the situation and take appropriate action.

Security and Retention of Your Information

We use administrative, technical, and organizational measures intended to protect personal information appropriate to the nature of the Services. No security measures are perfect or impenetrable, and we cannot guarantee perfect security.

How long we retain personal information depends on the purpose for which it is used and factors such as whether the information is needed to provide an account or service, complete or document a transaction, maintain security, resolve disputes, enforce policies, comply with legal obligations, or protect legal rights.

Where information is no longer reasonably required, we may delete, anonymize, or otherwise dispose of it in accordance with our operational and legal obligations.

Privacy and Security Incidents

Nub's Media maintains processes for reviewing suspected privacy or security incidents. Where applicable law requires notification to individuals or regulators, or requires records of a breach to be maintained, we will take the steps required by that law.

Your Rights and Choices

Depending on where you live, you may have some or all of the following rights in relation to personal information. These rights are not absolute and may apply only in certain circumstances or subject to legal exceptions:

  • Access / Know. You may have a right to request access to personal information we hold about you.
  • Delete. You may have a right to request deletion of personal information, subject to applicable exceptions and retention obligations. Nub's Media also provides an in-account deletion process for the Nub's Media community/account layer.
  • Correct. You may have a right to request correction of inaccurate personal information.
  • Portability. You may have a right in some circumstances to receive a copy of certain personal information. Nub's Media also provides Collection and Wanted List export tools for those account features.
  • Public-list choices. Collection and Wanted List sharing is private by default and can be enabled or disabled independently through available account controls.
  • Notification choices. Available community-notification preferences can be changed through account settings.
  • Marketing communication preferences. You may unsubscribe from promotional email using the unsubscribe option displayed in the message or other available preference controls.

You may exercise applicable rights where indicated in the Services or by contacting us using the details below. We may need to verify your identity before processing a request where permitted or required by law.

International Transfers

We and our service providers, including Shopify, may transfer, store, or process personal information outside the province, state, or country where you live. Personal information processed in another jurisdiction may be subject to the laws of that jurisdiction.

Where applicable law requires a recognized transfer mechanism for personal information transferred out of the European Economic Area or the United Kingdom, the responsible organization may rely on mechanisms such as applicable Standard Contractual Clauses, equivalent UK contractual safeguards, adequacy decisions, or another lawful transfer mechanism as appropriate.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to the Services, our practices, Shopify or service-provider functionality, or legal and regulatory requirements.

We will post the revised Privacy Policy on the website, update the "Last updated" date, and provide additional notice where required by applicable law.
